HYPE PRIVACY POLICY

This Privacy Policy describes what personal information Hype, Inc. d/b/a Hype ("Hype," "we," "us," or "our") collects, uses, and shares when you use our offerings and related services, which are accessible via our websites and applications.
By using www.hypegigs.com and any products or services associated with www.hypegigs.com, links to our products or services, or any websites, mobile applications, products, or services that link to this Privacy Policy (collectively, the "Services"), you agree to this Privacy Policy and consent to our data collection practices. If you do not agree with our policies or consent to our practices, please do not continue to use the Services. Beyond this Privacy Policy, your use of the Services may also be subject to our Worker Terms of Service and/or our Client Terms of Service.
Information You Give Us Directly
Workers (Creators/Students)
If you are an individual who connects or engages with Clients (as defined below) through the Services ("Worker"), we collect the information you use to create your profile. Depending on what you choose to include (some items may be required), this may include:
- (a) login and identification details (e.g., name, location, email, phone number);
- (b) resume/profile data (e.g., school, graduation year, interests, skills, experiences);
- (c) highlights, photos/images, captions, and tags;
- (d) responses to application or interview questions.
If you choose to link your Hype account to a third-party account (e.g., Google), we use the information you permit us to collect from that third party to facilitate account creation and log-in.
Clients (Brands/Employers)
If you are a client who uses the Services to engage Workers ("Client"), we may ask you and your authorized users for name, role, team name, industry, company description, logo, and website.
Payments
If you make a payment as a Client or receive a payment as a Worker, payment-related or other financial information is collected by our third-party payment processor(s) on our behalf. We do not directly collect or store full payment card information, though we may receive associated data (e.g., billing details).
We may create additional services, pages, or events that require more information to participate (e.g., online or in-person events or community forums). Information collected for those features is covered by this Privacy Policy.
Information Collected Automatically When You Use Our Services
When you use www.hypegigs.com or our apps, we may automatically collect:
- IP address;
- Mobile and other device identifiers;
- Browser information (type, language, settings);
- Referring/exit pages, landing pages, pages viewed;
- Platform type;
- Device, hardware, and software details;
- Usage information about how you interact with the Services (e.g., application trends, feature usage).
We may store information locally on your device via cookies, browser web storage, and app data caches.
Cookies & Similar Technologies
Cookies are small text files stored by your browser. We use cookies and similar technologies (including log files) to understand which pages you access and from where, monitor performance, and troubleshoot issues. You may control cookies in your browser settings; disabling cookies may affect some functionality.
Analytics
We may use analytics tools to record device data, geography, page views, session length, and interactions, to optimize the Services and for other operational purposes. Examples include (but are not limited to):
- Google Analytics (see Google's privacy materials; you can opt out via Google's opt-out tools),
- Smartlook (see Smartlook's privacy policy and opt-out options),
- Mixpanel (see Mixpanel's privacy policy and opt-out options).
Viewers of Shared Content
If you view content that users share (e.g., via a link), we may collect:
- IP address; device identifiers; browser info; referring/exit pages; platform type;
- whether you viewed content; view/download timestamps; number and length of views; and which portions were viewed.
We use this data to provide Services to our users, understand usage, identify trends, and detect/prevent malicious or unlawful activity. See "How We Use Your Information."
Information Provided to Us by Third Parties
We may receive information from third parties to supplement what we collect from you (e.g., how you reached our site or interacted with links). We may partner with additional third parties over time to improve the Services.
Third-party services are not controlled by us. We encourage you to read the privacy policies of websites and apps you interact with. We do not endorse, screen, or approve—and are not responsible for—the privacy practices or content of third-party websites or apps. Providing personal information to third parties is at your own risk.
We may display advertisements on www.hypegigs.com; some ads may be served by third parties that collect information via cookies and similar technologies.
Invites to Gigs
Workers and prospective Workers can be invited to view job postings ("Gigs") by Clients (or by Hype on a Client's behalf). If you are invited to a Gig, we may receive information about you in connection with that invite or referral. If you invite or refer a Worker, you represent you have the rights and consents to provide that individual's information.
How We Use Your Information
Creating User Profiles
- Workers: Your profile information populates your Hype profile and may be viewable by Clients and other Workers. Profiles may be searchable and filterable.
- Clients: Your company profile and associated information can be shown to Workers.
Provide the Services to Users
- Workers: Your account data (including resumes) may be parsed into templates and used within our products (including off-platform sharing when you choose it). We may notify you when a Client views or downloads your materials. We may use your data to create your profile, submit applications, follow company profiles, and communicate with Clients.
- Clients: We may process Client interaction data (e.g., viewing Workers' profiles/resumes) to provide Workers with analytics (e.g., views, downloads, message events). We may use your data to create accounts and company profiles, help you find Workers, communicate with Workers, and invite/add prospective Workers.
- Messaging: Messages sent via the platform are shared with the intended recipient(s).
Viewers
We may process viewer data to provide Services and analytics to our users, and associate such data with other information users provide.
Posting Gigs
Clients: Information you provide is used in connection with Gig postings, including any interview questions, highlights, or screening flows.
Improve Our Website and Services
We may use your information—alone or combined—to improve user experience, tailor content, and enhance the Services.
Emails, Texts, Push Notifications, and Other Messages
We may use your information to:
- provide updates about Hype, features, and content;
- send marketing, transactional, and automated notifications (product updates, education, newsletters);
- deliver customer support;
- market our Services and other offerings (including by email/SMS, where permitted);
- assist with advertising and marketing efforts.
Automated Decision-Making
We may use your information to use, train, or improve automated processes (e.g., ranking/sorting Workers by engagement). Hype will not rely solely on automated processing that has a legal or similarly significant effect on you unless necessary for a contract, you consent, or applicable law permits it.
Aggregated/De-Identified Information
We may generate anonymized, aggregated data for reporting. If we create or receive de-identified information, we will not attempt to re-identify it unless permitted or required by law.
Emails from Third Parties
We may use and share information to send users offers and information from third parties in similar spaces (e.g., contests, giveaways, ads). Where required, we'll request your consent or provide an opt-in.
Protection Against Liabilities
We may use personal information to protect us, our users, or others and to take precautions against liability, claims, investigations, abusive uses, and unlawful activity.
Consent
We may ask for your consent or provide an opt-in for certain uses of your personal information.
Retention
We may retain information as permitted by law. You may request deletion earlier; we may be unable to comply where retention is legally required.
How We Disclose Personal Information
Disclosures to Provide the Services
Third-Party Partners/Processors. We may share information with business/affiliate/marketing partners and service providers to analyze trends, improve the Services, and for other operational purposes. We may use and share such information publicly or with partners.
The information you provide may be shared with partners so they can invite you to apply to prospective Gigs. By creating an account, you consent to receiving such invitations, including for Gigs you did not directly apply to.
If you follow a Client's company profile, we may disclose your personal information to that Client.
Other Users You Share or Interact With. The Services may allow users to share personal information with other users.
Third-Party Services You Share or Interact With. The Services may link to or integrate with third-party websites, apps, services, products, and technologies ("Third-Party Services"). Any personal information shared with a Third-Party Service is subject to that service's privacy policy. We are not responsible for Third-Party Services' processing.
Hype Clients (Authorized Users Only). If you use the Services as an employee/contractor/authorized user of a Hype Client, that Client may access information associated with your use (e.g., usage data, communications, and files). Your information may also be subject to the Client's privacy policy. We are not responsible for the Client's processing.
Disclosures to Protect Us or Others
We may access, preserve, and disclose information if we, in good faith, believe it is required or appropriate to: comply with law enforcement or legal process; protect rights, property, or safety; enforce policies or contracts; collect amounts owed; or support investigations of suspected illegal activity.
Disclosure in Corporate Transactions
In a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, transition of service, or similar transaction, personal information may be disclosed, sold, or transferred.
Child Users
The Services are not intended for or targeted to users under 13 years of age ("Child Users"). Child Users should not use the Services. By using the Services, you represent you are over 13.
If we are notified that we collected information from a Child User, we will take steps to delete it as required by law. Parents/guardians may contact us at jack@hypegigs.com to request deletion.
Your Privacy Choices
Email Communications
You can use the unsubscribe link in our emails to opt out of marketing emails. You will still receive transactional or service-related emails (e.g., policy updates, security notices).
Text Messages
You may opt out of SMS by following the instructions in the text or contacting us at jack@hypegigs.com
Mobile Devices
Push notifications can be disabled in your device settings. With your consent, we may collect precise location data; you can revoke it in device settings. To request account deletion, use in-product deletion features or contact jack@hypegigs.com
"Do Not Track"
We do not respond to DNT signals or similar browser mechanisms.
Cookies & Personalized Advertising
You can control cookies in your browser; some features may not function if cookies are disabled. Cookie-based opt-outs generally don't apply to mobile apps. For interest-based ads in apps, use your OS settings (e.g., iOS/Android ad preferences). Industry opt-outs are available via the Network Advertising Initiative (NAI) and Digital Advertising Alliance (DAA). You must opt out separately in each browser and on each device.
International Users
We operate in the United States. If you use the Services from outside the U.S., you consent to the transfer of information to the U.S. and the application of U.S. law.
